WASHINGTON – President Barack Obama will nominate Solicitor General Elena Kagan to the Supreme Court, positioning the court to have three female justices for the first time, NBC News reported late Sunday.
Kagan served as the Dean of Harvard Law School from 2003 to 2009. She was widely viewed as a front-runner when Obama was considering candidates for a Supreme Court opening last year, but the president ultimately chose Sonia Sotomayor for the job.
At 50 years old, Kagan would be the youngest justice on the court, one of many factors working in her favor. She has the chance to extend Obama’s legacy for a generation.
Obama’s legacy will be death. Kagan’s judicial record is thin so her nomination will likely sail through the Senate. But what is clear from her record is her support of abortion.
Marjorie Dannenfelser of the Susan B. Anthony List said at Lifenews “In the past Kagan has been a strong supporter of the pro-abortion agenda. She has vigorously opposed the de-funding of taxpayer-funded clinics which promote abortions, despite the fact that a majority of Americans do not want their tax dollars to fund abortion providers.”
Get this, even Doug Kmiec, doesn’t like her that much.
Obama toady ambassador to Malta Douglas Kmiec told the Daily Caller that Kagan is “not my first choice” but called her fair-minded when it comes to conservative legal advocates.” Of course, Dougy does what Dougy is told to do.
Anyway, Kagan has cleared the Senate before and it is improbable that the Senate can muster enough to object now. Repeat after me, “The Senate does NOT care about abortion. The Senate does NOT care about abortion…”

It would be futile to try to filibuster her. If the Senate doesn't approve her Obama will just appoint Diane Wood who is even worse. The best Republicans can do is to set a precedent so that when the court hangs in the balance and a Republican is president, the democrats won't have an excuse to filibuster a anti-Roe judge.

Anonymous, the Republicans wouldn't be setting a precedent that the Democrats would follow. No matter what happens, the Republicans will be declared obstructionist and partisan.
Republican President nominates a candidate, and it's his fault the Senate Democrats have to filibuster the nomination because he picked such a divisive political hack.
Democrat President nominates a candidate, and Senate Republicans are obstructing the good intentions of the President, those nasty partisan hacks.
Trying to set a precedent is futile. I would much prefer to see someone, anyone, in the Senate stand up for what they believe in, to take a hard stance, to show some backbone, even if that particular cause will eventually be unsuccessful.
