For years, progressives unable to convince a majority of Americans of the rightness of their opinions looked to judges to change the law of the land via fiat, rather than putting their ideas up for a vote.
This has had disastrous consequences for this country. Access to abortion would clearly be very different in America if legislatures were allowed to vote but instead a majority of justices declared the killing of the unborn a “right” thereby cutting off all debate and leaving America with some of the most liberal abortion laws in the world.
The New York Times is now reporting a new end run around the peopl. Due to Republicans gaining strength in Congress, the Obama administration may look to regulation rather than legislation to pushing massive changes. In fact, it’s already starting.

Everyone saw this coming. The HHS will treat anything that isn't explicitly prohibited as fair game. This is how the HHS will eventually be able to subsidize abortions.

Don't count on B.O. being ousted in 2012. So far there is nobody on the Republican side that could unseat him. With two years to go he also has plenty of time to "reinvent" himself as a centrist President.
