The suit by the Little Sisters of the Poor asking for relief from the HHS contraceptive mandate is in the hands of Sonia Sotomayor. Yeah, I feel great about that, don’t you?

You know how I know we’re in trouble? Because Planned Parenthood and the ACLU don’t seem concerned at all.

Cecile Richards called it “a sideshow.”

Brigitte Amiri of the American Civil Liberties Union told NBC News that she is not concerned by Sotomayor’s action.

“Justice Sotomayor wants to make a thoughtful decision,” she told NBC News. “I think this temporary holding pattern isn’t a cause for concern at this point.”

When Planned Parenthood and the ACLU aren’t worried, I am.

I know this case isn’t the end all and be all of the fate of religious liberty. There are many lawsuits out there against the HHS mandate and I’m pretty sure that this will eventually be heard by The Supreme Court. But that doesn’t actually make me feel that much better.

I know the court somewhat recently unanimously decided in favor of a Christian school’s ability to hire and fire at will under the ministry exception in the Hosanna-Tabor case. But I’m still not resting easy. I’m the guy who thought for sure that Obamacare would be deemed unconstitutional. Yeah, I was a little wrong on that one.

Let’s just say that if I were picking nine people to decide the fate of religious liberty in this country, I probably wouldn’t pick at least six of the nine.
